These terms cover the stream tools Hell Is Not Full makes and runs for streamers: RIBBIT and its versions, any custom version made for you, the Channels dashboard, and hosting at live.hinf.stream. Hell Is Not Full is a sole proprietorship ("we", "us"). By buying, signing up for or using a tool, you ("you", the streamer) agree to these terms. Questions: [email protected].
The short version
- You're buying a licence to use our tools on your own channel. You aren't buying the tools themselves.
- We keep the rights to everything we make, including a custom version made for you. You keep the rights to your own name, logo, art and other material you give us.
- No refunds once something is delivered or work has started, except where the law says otherwise.
- Hosting runs for the term you paid for. It's provided as it is, and we can't promise it will never go down.
1. Who can buy
You must be 18 or older to buy or sign up for a tool, or to manage a channel on our dashboard. Your viewers just need to meet Twitch's own age rules to take part in your chat.
2. What you can buy
- Free: hosted only, with limited features and a "Powered by Ribbit" credit on stream. We can change or stop it at any time.
- Standard: RIBBIT as it is, for one channel. A one-time purchase, with optional hosting for one year. It includes the files to run it yourself under the Self-Host Licence.
- Custom: a version in your branding (art and colours, a host character, animation, voice and lines). It's priced by the work, in a quote we agree with you in writing. It's hosted by us (for an extra hosting fee) or run by you under the Self-Host Licence.
What's in each tier, and the prices, are in the quote we give you. If a quote and these terms disagree, the quote wins for that order.
3. Your licence
Once you've paid, we give you a non-exclusive, non-transferable licence (exclusive for a custom design made for you, see section 4) to use the tool you bought on the Twitch channel named in your order, for your own streams. This includes showing it on stream, in VODs, clips and highlights.
You may not:
- use it on any channel other than the one named, or run it for other streamers;
- sell, resell, rent, share, sublicense or give away the tool, its files, art, sounds, voice or code;
- copy, extract or reuse its art, characters, sounds, music or voice outside the tool;
- reverse-engineer it, remove credits or notices, or get around limits or tiers;
- use it in a way that breaks Twitch's rules or the law.
If you want it on more channels, buy more licences.
4. Custom versions
- Our rights. We own all rights in what we create for your custom version: its design, characters, art, animation, sounds, music, voice, lines and code. This also covers anything we create from your brief or references, and the game engine and tools underneath it.
- Your exclusive licence. For the custom design made for you, your licence is exclusive. We won't sell or licence that design, or a confusingly similar one, to anyone else while your licence is active. We may reuse general techniques, code and anything that isn't specific to your branding.
- Your material. You keep all rights to what you give us: your name, channel name, logos, existing characters and art. You give us a licence to use that material only to make, run, support and show your version. You confirm you have the right to give it to us.
- Showing our work. We may show your custom version in our portfolio and promotion (screenshots, short clips, your channel name). Tell us if you'd rather we didn't, and we'll stop.
- Buyout. If you want to own the custom design outright, that's possible by a separate written agreement and fee. Otherwise this section applies.
- Names. RIBBIT™ and Hell Is Not Full™ are our trademarks. Your licence doesn't let you use them except to show the tool as we made it.
- Approval. We'll show you the work before it goes live. Once you approve it, or use it on stream, it counts as delivered. Changes after that are new work.
5. Payment and refunds
- Prices are in USD. You pay through PayPal, before delivery or as set out in your quote (for example, a deposit before work starts). We never see your card or bank details.
- No refunds for digital goods once they're delivered or available to you, for custom work once it has started, or for hosting already paid for. The exception is where the law requires a refund. If something we sold you doesn't work as described, tell us and we'll fix it or make it right.
- Hosting renews only if you choose to renew. If hosting ends and you don't renew, a Standard channel drops to the Free tier. A custom version stops being hosted, but you can still run it yourself if your order included the Self-Host Licence.
6. Hosting
- We run hosted tools on our own server. We aim to keep them up during your streams, but we don't promise any particular uptime, and there may be maintenance and outages. If an outage is long or keeps happening, tell us.
- Updates are applied between streams where we can. A refresh of your browser source picks them up.
- We back up channel settings and scores, but you shouldn't rely on us as your only record of anything.
7. Your account and chat
- You sign in with Twitch to manage your channel. Keep your Twitch account secure. Anything done through your sign-in counts as done by you.
- The tools read your channel's public chat to play the game and keep Twitch user IDs, names and scores for leaderboards. Our privacy notice explains what we keep and for how long: https://hellisnotfull.com/privacy/.
- You're responsible for your stream and chat, including moderating it. Twitch's own terms apply to your channel.
8. Suspension and ending
- We may suspend or switch off a tool on a channel that breaks these terms (for example, it's used on another channel or shared), that isn't paid for, or that harms our service or others. Where we reasonably can, we'll tell you first and give you a chance to fix it.
- If your licence ends because you broke these terms, you must stop using the tool and delete any self-host files. Sections 4 (our rights), 9, 10 and 11 still apply after that.
- You can stop using a tool at any time. Section 5 covers refunds.
9. No guarantees
Our tools are provided as they are and as available. We don't promise they'll be error-free, uninterrupted or suit a particular purpose, beyond what the law doesn't let us exclude.
10. Limits on our responsibility
As far as the law allows, we aren't responsible for indirect or consequential losses, for lost income, viewers, followers or sponsorships, or for problems caused by Twitch, OBS, your computer or your internet. Our total responsibility for any claim is limited to what you paid us for the tool in question in the 12 months before the claim. Nothing here limits rights you have that the law doesn't let us limit.
11. Your responsibility to us
If someone makes a claim against us because of material you gave us, or because of how you used the tool against these terms, you'll cover our reasonable costs of dealing with it.
12. Third-party material
The tools include material made by others under their own licences, such as fonts, word lists and word-frequency data. Their notices are listed at https://hinf.stream/notices/ and ship with the self-host files. Those licences apply to those parts.
13. Law and disputes
These terms are governed by the laws of the State of Minnesota, USA. Before going to court, we'll both try to resolve a dispute by email first. Disputes go to the state or federal courts serving Dakota County, Minnesota, unless the law lets you bring a claim where you live.
14. Changes
If these terms change, the date below changes too. For anything you've paid for, we'll email you about changes that affect you, and the terms in force when you bought apply to that purchase.
